1. Acceptance of Terms

By accessing or using our platform, you agree to comply with these Terms and Conditions, which may be updated from time to time. These terms and conditions, together with the Seller Policy Page, Return Policy Page, Support Policy Page and Privacy Policy Page (the "Annexures") form this Agreement.

2. User Eligibility

• You must be at least 18 years old or have parental consent to use this platform.
• By creating an account, you confirm that all information provided is accurate and complete.

3. Account Responsibilities

• Users are responsible for maintaining the confidentiality of their account information and passwords.
• You agree to notify us immediately of any unauthorized use of your account.

4. Buying Items

• Buyers need a Customers Account (Buyer's account) to buy items.
• Buyers agree to pay the specified price for items listed on the platform.
• All sales are final unless otherwise stated in the seller’s return policy.
• Buyers should read item descriptions and seller policies carefully before making a purchase.
• Buyers need to inform sellers once orders are delivered successfully.

5. Selling Items

• Sellers need to register a Sellers Account to sell items.
• Sellers are responsible for accurately describing their products, including any defects or issues.
• All listings must comply with applicable laws and regulations, and prohibited items may not be sold.
• Sellers must fulfill orders in a timely manner and communicate with buyers regarding any issues.
• Sellers listing anything that is not approved or in line with the guidelines of this platform will be fined as set out in section 6 of the Terms and Conditions page.
• Sellers need to update the status of orders. No payouts can be requested until orders are delivered successfully.

6. Pricing, Fees and Fines

• Sellers are responsible for setting their own prices. All applicable fees will be disclosed during the selling process.
• Sellers need to select the Seller Subscription Package (FREE Seller Package) from the sellers dashboard before items can be listed.
• A successful sale fee of 5.5% is charged on all sales. (e.g. If an item sells for R100, a 5.5% fee of R5.50 will be deducted from the item price and the seller will receive R94.50 (R100 - R5.50 =R94.50) on payout request). 
• Sellers will be fined a FLAT fee of R10 per listing, where items listed are not allowed by the guidelines of this platform.
• Buyers are responsible for any additional costs, such as shipping and taxes.

7. Payment Processing

• All payments will be processed through our secure payment system.
• By making a purchase, you authorize us to charge your payment method for the total amount due.

8. Returns and Refunds

• Return policies are determined by the seller and must be clearly stated in the listing.
• Buyers must adhere to the seller’s return policy when requesting a return or refund.

9. Intellectual Property

• Users retain ownership of any intellectual property rights related to their listings.
• By listing items, sellers grant us a non-exclusive license to use, display, and promote their listings on our platform.

10. Limitation of Liability

• Our platform is not liable for any damages arising from the sale or purchase of items, including direct, indirect, incidental, or consequential damages.

11. Indemnification

• Users agree to indemnify and hold harmless our platform and its affiliates from any claims, losses, liabilities, or expenses arising out of their use of the platform or violation of these Terms.

12. Governing Law

• These Terms and Conditions are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.

13. Changes to Terms

• We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page, and your continued use of the platform signifies your acceptance of those changes.
